Terms of Use
This Terms of Use agreement constitutes a legally binding agreement between you and Funding2Grow (the “Company”).
By accessing or using this website and any related sub-sites (collectively, the “Site”), and/or by using any products or services made available through the Site (the “Services”), you acknowledge that you have read, understood, and agree to be bound by these Terms of Use and the Funding2Grow Privacy Policy (collectively, the “Terms”) for as long as you continue to access or use the Site or Services. The Services may include products or integrated features provided or supported by third parties.
IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST NOT ACCESS OR USE THE SITE OR SERVICES. Certain Services may be subject to additional terms and conditions, which will either be included within these Terms or presented to you at the time you register for or purchase such Services. Your use of those Services constitutes acceptance of any additional applicable terms. Where additional terms require your affirmative acceptance, you must review and accept them before the applicable Service is activated.
Nature of Services
Funding2Grow connects qualified small business owners with banks, credit unions, and alternative lending institutions. Through proprietary technology and data-driven evaluation processes, the Company assists business owners in identifying suitable financing categories and potential lending partners that align with their business profile. Where appropriate, business owners may be introduced to third-party lenders; however, Funding2Grow does not guarantee financing approval or specific loan terms. Funding2Grow may also facilitate access to integrated products and support application preparation, communications, and handoff to the applicable provider. Unless expressly stated in the terms governing a particular product, Funding2Grow is not the lender, depository institution, or provider of the underlying financial product and does not make the provider’s credit decision.
Integrated Provider Features
Funding2Grow may make business financing, Instant Payout, settlement-management, and related features available through workflows supported by one or more third-party technology providers, program managers, banks, lenders, servicers, or other financial-services providers and their respective affiliates (each, an “Integrated Provider”). An Integrated Provider may provide technology, onboarding, program-management, settlement-administration, monitoring, marketing-support, servicing or servicing-support, banking services, or business credit products, as applicable. Business loans may be originated by an Integrated Provider acting as the applicable bank or lender and may be serviced by an Integrated Provider acting as the applicable servicer, subject to credit approval and the applicable product documents. Funding2Grow is not the lender or depository institution.
Information and Onboarding Preparation
You authorize Funding2Grow to collect, use, and disclose information about you, your business, owners, control persons, authorized representatives, applications, financial condition, bank and account activity, payment-processing and transaction activity, settlement history and flows, linked bank accounts, and related fraud, compliance, risk, and servicing information to the applicable Integrated Providers, processors, and other providers involved in an Integrated Provider feature, including before you begin or submit an application.You authorize the applicable recipients to receive and use this information to identify potential product fit or eligibility, identify businesses for outreach, prepopulate and prepare an application or enrollment experience, verify information, support underwriting and fraud-prevention activities, communicate directly with you on Funding2Grow’s behalf or about Funding2Grow-integrated offerings, present available features, and support settlement, monitoring, servicing, compliance, reconciliation, and reporting. You represent that you are authorized to provide information concerning your business and its owners, control persons, and authorized representatives for these purposes.
Separate Product Acceptance
The sharing or processing of information under this section does not submit an application on your behalf, obligate you to accept a product, activate a loan or Instant Payout, establish a managed settlement arrangement, or authorize settlement routing, recoupment, or the application of settlement proceeds. If you elect an Integrated Provider feature, the privacy notices of the applicable Integrated Providers and any Integrated Provider or product-specific terms, disclosures, and authorizations will be presented for your review, acknowledgment, or acceptance, as applicable, through or in connection with the relevant application or enrollment flow.
Ongoing Support After Acceptance
If Funding2Grow participates in ongoing support for an Integrated Provider product you accept, you authorize Funding2Grow to provide continuing application, account, transaction, processing, or settlement information reasonably necessary to support that product in accordance with the terms you accepted. To the extent Funding2Grow is operationally responsible for implementing processing or settlement instructions, you also authorize Funding2Grow to implement instructions that you separately authorized under the applicable Integrated Provider or product terms.
Availability, Advice, and Continuity
Making a feature available, presenting potential eligibility, or prepopulating information does not guarantee approval, funding, availability, payout timing, or particular terms. Information presented by Funding2Grow is not legal, tax, accounting, financial, or credit advice. If you have accepted an Integrated Provider product, termination of these Terms, your access to the Site or Services, or your relationship with Funding2Grow will not, by itself, terminate that product or discharge any outstanding obligation under it. The governing product terms will control any continuing product, settlement, repayment, servicing, and recordkeeping rights and obligations.
Changes to These Terms
Funding2Grow reserves the right, at its sole discretion, to update, modify, amend, or remove portions of these Terms at any time. Updates will become effective immediately upon posting to the Site. Your continued use of the Site or Services following the posting of revised Terms constitutes your acceptance of such changes. Users are encouraged to review these Terms periodically to remain informed of any updates. If a change materially affects an existing financial product or merchant relationship, Funding2Grow will provide notice and obtain acceptance through a method required by the applicable agreement and applicable law.
Content and Intellectual Property
All content available on the Site, including but not limited to text, graphics, user interfaces, visual elements, photographs, trademarks (registered or unregistered), logos, audio, artwork, software, and computer code (collectively, “Content”), is owned by or licensed to Funding2Grow and is protected by applicable intellectual property, trademark, copyright, and unfair competition laws.
No Content may be copied, reproduced, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, or distributed in any way without the Company’s prior written consent. Any unauthorized use of the Content may result in legal action to the fullest extent permitted by law.
Each Integrated Provider and each other provider retainsall rights in its respective technology, content, trademarks, and services. No rights are granted except as expressly stated in the terms governing the applicable feature.
